% 21.02.2017 Learned counsel for the petitioner submits that FIR No. 896/2015 under Sections 354(A)/506/509 IPC was registered at Police Station Sarai Rohilla more than 11⁄2 years ago, on the complaint of prosecutrix, who is a married woman.
Petitioner was employed in a Yashika Health Club. Prosecutrix had joined the health club for reducing the weight. Prosecutrix has falsely implicated the petitioner. Charge-sheet was filed under Sections 354-A/506/509 IPC. It is submitted that learned Magistrate has also taken
cognizance of the offence under Section 328 IPC after filing of the chargesheet, in view of the fact that prosecutrix has stated in her statement that petitioner had made her to smell a perfume bottle, after which she felt giddiness.
Investigations are complete.
Petitioner had participated in the investigations. He was released on bail since offences were bailable. Keeping in mind the totality of circumstances, it is ordered that in case of arrest, petitioner be released on anticipatory bail subject to his furnishing a personal bond in the sum of `25,000/-(Rupees Twenty Five Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned. Bail application is disposed of in the above terms. Dasti.
