The present revision petition is directed against an order of the District Court dated 30.10.2019 in CS No. 59027/2016, by which an application filed by the petitioner-plaintiff under Order XII Rule 6 of the Code of Civil Procedure, 1908, was dismissed. 2.

The suit has since been converted into a commercial suit and renumbered as CS(C) 83/2021 which remains pending before the District Judge (Commercial Court), North District, Rohini Courts. 3.

After some arguments, learned counsel for the parties submit that this revision petition may be disposed of, with a request to the C.R.P. 29/2020 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Commercial Court to decide the suit as expeditiously as possible. 4.

Mr. Rohit Gandhi, learned counsel for the respondent-defendant, submits that the suit has not progressed over the last five years while the matter has been pending before this Court due to adjournments sought by the petitioner. Without getting into that question, learned counsel for both parties assure the Court that they will cooperate with the Commercial Court in the expeditious disposal of the suit, and that no unnecessary adjournments will be sought.

I am informed that the matter is pending before the Commercial Court for consideration of certain applications and for framing of issues, after which parties may be required to lead evidence. The parties are at liberty to seek appropriate directions from the Commercial Court as required.

It is expected that the Commercial Court will also exercise all powers of case management and other measures available to it, to ensure that the suit is not unnecessarily prolonged and will endeavour to dispose of the suit as expeditiously as practicable.

The revision petition, alongwith the pending application, stands disposed of.
