Present application has been moved seeking clarification of order dated 18.12.2023.

This Court has gone through the contents of said order very carefully. Though Para-10 & Para-11 are quite specific but while dismissing the aforesaid petition, this Court also made observations in Para-13 and it seems that in view of aforesaid observations, learned Trial Court has struck off the defence of the defendant.

Keeping in mind the facts of the case, it is quite evident that since order dated 18.12.2023 is very clear and specific, it does not require any clarification. However, needless to say, if the petitioner (defendant before the learned Trial Court) feels aggrieved by order dated 31.05.2024, it will be always open to him to challenge the same in accordance with law. 5.
