Mr. Rakesh Shrivastava, learned counsel for the respondent has joined proceedings on advance notice through video-conferencing. 2.

After hearing arguments for some time, learned counsel for the petitioner does not press the present petition.

He, however, submits that it be clarified that the impugned order, whereby the amendment in the suit in question has been allowed, should not prejudice the mind of the learned Controller who is seized with application seeking leave to defend.

The present petition is accordingly disposed of as not pressed. 5.

All the rights and the contentions of the parties are left open and it is also clarified that that the learned Controller would decide the application seeking leave to defend, without being influenced by the impugned order dated 05.07.2025. 6.
