This petition is filed for quashing of summoning order dated 25th July 2017 qua the petitioner passed by the Metropolitan Magistrate, Patiala House Courts. Counsel for petitioner poinst out that petitioner is a wholetime Director and Company Secretary of M/s. Kone Elevator India Pvt. Ltd. and has been summoned in CC No. 14514/2019 under Section 22-A 0f the Minimum Wages Act, 1948.

Aside from various grounds on which the challenge is mounted, counsel for petitioner states that the petitioner is Director of the Company and is based in Chennai and they have now received notice, after 5 years of the complaint filed in 2019.

The Company is already being represented through its Authorised Representative.

Accordingly, petition is disposed with the limited direction that petitioner be exempted from personal appearance, unless necessitated by the Trial Court.
