This petition seeks quashing of summoning order dated 3rd November 2023 arising out of proceedings under Section 138 NI Act. 2.

Counsel for the petitioner states that the petitioner though had signed the cheque in question, but had already resigned from Directorship in July 2022, prior to cheque being signed.

Petitioner requests that since he is located in Maharashtra, may be granted exemption from personal appearance before the Trial Court. 4.

Accordingly, petition is disposed with the limited direction that petitioner be exempted from personal appearance, unless necessitated by the Trial Court. Besides, the petitioner, if so required, may also be permitted to appear through video conferencing, as and when necessitated by the Trial Court.

It is made clear that this Court has not passed any observations on the merits of the mater.

Petition is disposed of with these directions. 7.
