The present petition under Section 482 of the Cr.P.C. seeks the following prayers:- "(a) Quash the Complaint case bearing No. as CC No. 5220/2019 titled as Hari Rajani vs. Naveen Sahni pending before the court of Ld. Magistrate, Tis Hazari Court, Delhi and set aside summoning order dated 06/06/2019 passed in this case.

(b) Passed any order (s) or direction as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case." 3.

It is pointed out that in the original complaint, the respondent had arrayed Naveen Sahni as an accused. It is further submitted that on an application filed by the respondent, the learned Trial Court has taken on record an amended complaint by changing the name from Naveen Sahni to Naveen Kumar (present petitioner). It is stated that the order has already been challenged by way of a revision petition.

withdraw the present petition with liberty to pursue the proceedings already instituted challenging the aforesaid order, with further liberty to the petitioner to take all the contentions taken herein before the learned Trial Court during the course of the trial.
