% 24.05.2017 It is not proper to draw conclusions as to the credibility of the first informant by contrasting his version in the court against the input recorded in PCR which was an information passed on through several hands. The first informant is stated to have positively identified the applicant as one of the perpetrators of the incident wherein offences as grave as those punishable under Section 302/394/34 of the Indian Penal Code, 1860 were committed. Having regard to the stage of the ongoing trial, it is not a fit case where release on bail should be granted.

Dismissed.
