Mr. Aditya Wadhwa, learned counsel for the plaintiff, realises that he, first, has to attempt mediation under Section 12A of the Commercial Courts Act, 2015 (CC Act). He, therefore, is granted liberty to withdraw the instant civil suit reserving all rights and contentions and re-institute the same after complying with the requirement under Section 12A of the CC Act. 2.

Since the suit is on its first date of hearing, the plaintiffs will be entitled to set off an equal amount of the Court fees which has been paid in the instant case, in the fresh suit, if the same is filed. 3.
