On the last date of hearing, noting the absence of the appellant as well as his counsel, the Investigating Officer was directed to serve notice upon the appellant and his surety(ies).

Today, a status report has been handed over, as per which the SI deputed to serve the notice visited the address of the appellant and met one 'Rakesh Kumar Jain', who claimed to be the brother of the appellant. He informed that the appellant had expired on 06.01.2021 at Meerut, Uttar Pradesh.

Learned APP for the State has handed over a copy of the verification report, which is taken on record.

The legal heirs of the appellant have not preferred any application seeking continuation of the present appeal on merits. 5.

In view of the aforesaid facts and circumstances, the proceedings in the present appeal stand abated and the same is disposed of accordingly.
