Present appeal has been preferred under Clause X of the Letters Patent Act, 1866 assailing the judgment dated 31st July, 2024 passed by the learned Single Judge of this Court, whereby the writ petition being W.P.(C) 10513/2024 titled as Dharmendra Kumar Sharma vs. Union of India & Ors., filed by the appellant challenging the letter dated 22nd February, 2024, was dismissed.

The letter dated 22nd February, 2024 clearly intimates that the period of license of the appellant, including the period extended during Covid-19 pandemic by the respondent no.2 as a policy decision, is expiring on 21st August, 2024.

Learned counsel for the appellant seeks parity with the petitioners in a batch of writ petitions being W.P.(C) 6771/2024 titled as Ved Prakash Mishra vs. Union of India & Ors. and connected matters, wherein vide order dated 30th May, 2024, the said writ petitions were dismissed however an extension of three months was granted to the petitioners therein for vacating their stalls.

It is also submitted that in a similar appeal being LPA 767/2024 titled as Asha Shukla vs. Union of India & Ors., this Court has already extended such benefit of three months extension to the appellant therein. 5.

Accordingly, the present appeal alongwith the applications is disposed of giving three months time to the appellant from 21st August, 2024 to vacate his catering stall in question. In the event the said catering stall is not removed on the expiry of extended ninety days, the respondents shall be at liberty to forthwith remove the goods of the appellant, without filing any petition.
