Although, there are several limbs to the prayer made in the appeal, counsel for the appellant says that the only grievance he wishes to press concerns the failure of the learned Family Court Judge to adjudicate the application preferred under Section 340 of the Code of Criminal Procedure, 1973.

Accordingly, the appeal is disposed of with a direction that if such an application has not been decided, the learned Family Court Judge will adjudicate the same, albeit after hearing the parties and/or their counsel. 3.

Before adjudicating the aforementioned application, the Family Court will issue notice to the respondent.

List the matter before the concerned Family Court on 04.09.2024, for taking further steps in the matter with regard to adjudication of the aforementioned application.
