By way of the present application, the applicant seeks condonation of delay of 85 days in re-filing the present petition. 2.

For the reasons mentioned in the application, the same stands allowed. The delay of 85 days in re-filing the present petition stands condoned. 3.

By way of present petition, the petitioners are seeking quashing of FIR bearing no. 80009422/2024, registered at Police Station Dabri, New The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Delhi, for the commission of offences punishable under Sections 380/454/34 of the Indian Penal Code, 1860 (hereafter 'IPC'). 5.

The petitioners and respondent no. 2 are appeared before this Court. They have been identified by their counsels and concerned Investigating Officer (IO) from Police Station Dabri (Dwarka), Delhi. 6.

Briefly stated, the facts of the present case are that on 29.01.2024, the respondent no. 2 made a written complaint to the Police Station Dabri, New Delhi against the petitioners, alleging therein that on his arrival from France to his house, he since 2013 is doing the job of chef in France. On 29.01.2024 when the respondent no. 2 had come to Delhi from France, his household articles were stolen by the petitioners. Thereafter, on the complaint of the respondent no. 2 an FIR was registered at P.S. Dabri, New Delhi against the petitioners under the relevant sections. It is stated that during pendency of the said Civil Suit filed by the respondent no. 2 as well as the divorce petition filed by the petitioner no. 1, both the parties have amicably settled their dispute vide Settlement Agreement dated 01.03.2025. 7.

On a query made by this Court, respondent no.2 who has been identified by the concerned IO, has categorically stated that he has entered into compromise out of his own free will and without any pressure, coercion or threat. It is also stated by respondent no. 2 that the entire dispute has been amicably settled between the parties. Respondent no. 2 further states that he has no objection if the present FIR is quashed. 8.

In view of the above fact that the parties have amicably resolved their differences of their own free will, without any coercion and no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 9.

Accordingly, FIR bearing no. 80009422/2024, registered at Police Station Dabri, New Delhi, for the commission of offences punishable under Sections 380/454/34 of IPC and all consequential proceedings emanating therefrom are quashed.

In view of the above, the present petition stands disposed of. 11.
