Application under Section 151 of C.P.C. has been filed on behalf of Respondent No.2 / Mr. S. Jaijeet Singh seeking release of 1/3rd of the deposited amount, which was deposited with the Registry of this Court, pursuant to Order dated 05.09.2024.

Learned counsel for the Appellant opposes this Application and submits that it was a conditional Order, whereby the Appellant was permitted to reagitate his Application under Order IX Rule 13 of the C.P.C., subject to a deposit of Rs.5,00,000/- with the Registry of this Court and still Appellant's right is to be agitated by learned Trial Court, therefore, the amount may not be released.

Application under Order IX Rule 13 of the C.P.C. has already been allowed by the learned Trial Court and the case of the parties is yet to be agitated on merits.
