The present petition has been filed by the petitioner seeking that the respondent be directed to decide the petitioners' application under Section 12(4) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, seeking compensation. The said application has been filed in the backdrop of FIR No.246/2023, PS Subhash Palace and order dated 25.04.2024, passed by the learned ASJ-II/Special Judge NDPS/, North West, Rohini Courts, Delhi whereby it has been directed as under: "As per Section 15A (11) of the Act, it is the duty of the State to specify the appropriate scheme to ensure the rights and entitlements of victims and witnesses in accessing justice. Clause (b) provides of monetary relief in cash or any kind to the victim or the the dependants. 1995 Rules under Rule 17 provides for district level vigilance and monitoring committee and Rule 17(A) provides for constitution of sub division level vigilance and monitoring committee. The role of this committee is to implement the rights provided under Section 15 (A) of the Act for relief and rehabilitation of the victim and other matters connected with them. It is, therefore, the duty of sub division level vigilance and monitoring committee of which the SDM concerned is the chairperson with block development officer to inquire into and rehabilitate the victim as per the rules.
In these circumstances, all these three application be sent to SDM area concerned for disposal of all the application and providing relief to the victim, as per Rules provided under 1995 Rules." 4.
Learned counsel for the respondent submits that the concerned SDM would urgently examine the aforesaid application of the petitioners and take an appropriate decision by passing a reasoned order as expeditiously as possible and in any event within a period of two months from today. It is directed accordingly.
