A copy of the counter-affidavit has been handed over by the learned counsel for the MCD. The same is directed to be filed with the Registry of this Court during the course of the day.

The learned counsel for the MCD states that the petitioner has not given possession of the site allotted to him - site no. 11/30, near wall of Police Station, Karol Bagh, New Delhi as another person (Dinesh Kumar) is occupying the said site. She states on instructions, that no permission has been granted to Sh. Dinesh Kumar to occupy the said site and requests for further time to make appropriate arrangements for shifting Sh. Dinesh Kumar to another place. She states that the same would be done within four weeks and the possession of the site would be handed over to the petitioner. 3.

The MCD is bound down by the said statement made on its behalf. In view of the said statement, no further orders are required to be passed in this petition.
