This application has been filed by the Petitioner seeking regular bail under Section 439 Cr.P.C. in case FIR No.555/2021 dated 21.10.2021 registered at PS: Swaroop Nagar under Section 376 IPC read with Section 4 POCSO Act.

Ms. Shubhi Gupta, learned APP states that the matter before the Trial Court is at the stage of prosecution evidence, wherein the prosecutrix has been examined and the matter is now fixed for 15.05.2024 for examination of the mother of victim and therefore, at this stage, the present application be not allowed.

Counsel for the Petitioner, on instructions, seeks to withdraw the application with liberty to approach the Court after the evidence of mother of the complainant is over.
