At the outset, learned CGSC appearing for respondent no.1 submits that the appellant shall be given a hearing in the Review Petition No.E38/8/2021/DEL filed by the appellant under Section 77(1) of the Patents Act, 1970 pending before the Assistant Controller of Patents & Designs prior to its adjudication within a period of six weeks. 2.
In view thereof, learned counsel for the appellant seeks to withdraw the present appeal, especially if the same is adjudicated afresh on its own merits alongwith the grounds urged by the appellant herein and disposed of within the aforesaid period of six weeks.

The present appeal is accordingly disposed of as withdrawn in the aforesaid terms and the Assistant Controller of Patents & Designs is directed to grant fresh hearing(s) to the appellant in the Review Petition No.E-38/8/2021/DEL, who will be free to urge the grounds of review The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. therein as also the grounds urged herein, prior to its adjudicating the same on merits within the aforesaid period of six weeks from the receipt of this order.

Resultantly, the Registry of this Court is directed to supply a copy of this judgment to the Office of the Controller General of Patents, Designs and Trademarks, Boudhik Sampada Bhawan, Plot No.32, Sector14, Dwarka, New Delhi-110078. 5.
Learned CGSC appearing for respondent no.1 is also directed to apprise respondent no.1 about the outcome of the present order. 6.
The present appeal, along with pending applications, if any, is disposed of.
