The learned counsel for the complainant refers to the order dated 28.02.2024 to contend that the petitioner was granted interim bail for a period of 45 days to arrange for the funds and to re-pay the same to the complainant on the conditions mentioned in paragraph 6 of the said order. 2.
He submits that the condition mentioned in the paragraph 6 of the order dated 28.02.2024 under clause (c) has not been complied with, in as much as, the petitioner has neither furnished his address, as well as, his mobile number to the I.O concerned nor has he marked his attendance on every Saturday in terms of condition mentioned in clause (e) of paragraph 6 of the said order.

Mr. Neeraj Bhatia, who has joined through VC, submits that he has furnished a surety bond for the petitioner before the learned Trial Court and he has also moved an application seeking his discharge as surety. In view of the above, the Jail Superintendent is directed to furnish a report to the learned Trial Court as to whether the petitioner has surrendered after the expiry of period of interim bail of 45 days granted to him. 5.
The learned Trial Court is also directed to proceed in accordance with law after the receipt of the report from the Jail Superintendent. 6.
The present bail application is also dismissed for non-prosecution as there is no appearance on behalf of the petitioner. 7.
Copy of the order be forwarded to the concerned Jail Superintendent, as well as, the learned Trial Court for necessary compliance and information.
