This application has been filed under Section 439 of the Code of Criminal Procedure, 1973 (in short, 'CrPC') praying for release of the applicant on regular bail in FIR No.0134/2020 registered with Police Station: Anand Parbat, Central-District, Delhi, under Sections 307/324/506/34 of the Indian Penal Code, 1860 and Sections 25 and 27 of the Arms Act, 1959.

The learned counsel for the applicant submits that the other coaccused have already been released on bail. He further submits that, in fact, the entire case of the prosecution arises out of some money transaction which was owed by the victim to one Satender, who has not been arrested. On the other hand, the learned APP submits that part examination of the main witness, that is, the complainant/injured, has been recorded before the learned Trial Court. He submits that the prosecution will produce both the injured before the learned Trial Court on the next date of hearing.

Keeping in view the above, the present application is disposed of requesting the learned Trial Court to expedite the recording of the evidence of the two alleged injured/eye-witnesses at the earliest. On conclusion of their evidence, the applicant shall be at liberty to file a fresh application seeking bail, which shall be considered in accordance with law.
