1. The appellant is no more.

2. The said factum of death has been verified by the respondent/CBI.

3. However, the sentence awarded by the trial court is a substantive sentence of imprisonment and fine. 4. Advocate Mr. Suhail Khan appears on behalf of the son of the appellant and submits that the fine awarded by the trial court has already been deposited. The legal representatives of the appellant does not wish to prosecute the present appeal.

5. In view of the above, the impugned judgment dated 12.09.2006 stands confirmed.

6. The file be consigned to the record room.
