The present application under Section 36 of the Arbitration and Conciliation Act, 1996 seeks enforcement of the arbitral award dated 08.05.2020. The said arbitral award was also the subject matter of OMP.05/2020 filed by the respondent under Section 34 of the Arbitration and Conciliation Act, 1996.

Vide judgment dated 04.12.2023, the aforesaid petition under Section 34 of Arbitration and Conciliation Act, 1996 was dismissed by this Court. Thereafter, an appeal under Section 37 of Arbitration and Conciliation Act, 1996 has been filed against the said judgement before the Division Bench of this Court titled as Meera Goyal v. Priti Saraf bearing FAO(OS) 09/2024. The Division Bench has stayed the operation of the arbitral award dated 08.05.2020, subject to deposit of Rs. 12.50 Crores along with interest. The requisite amount, as directed by the Division Bench, already stands deposited and liberty has also been granted to the respondent to apply for release of the amount against solvent security. 3.

been stayed, no purpose would be served by keeping the present proceedings pending while the matter is under consideration by the Division Bench. 4.

However, liberty is granted to the decree holder to file afresh, subject to the orders that may be passed by the Division Bench seized of FAO(OS). 09/2024. All rights and contentions of the decree holder are expressly reserved.
