This appeal is directed against a decree of the learned Trial Court dated 21.09.2015. The decree was passed consequent upon the failure of the appellant to deposit the principal amount claimed, subject to which the leave to defend was granted.

The appeal was admitted by order dated 08.08.2017. There was no appearance on behalf of the parties on seven occasions when the matter was taken up in the Regular list. On the last date of hearing, i.e., 18.10.2024, Court notice was issued to the parties and their learned counsel on record. The Registry reports that notice was duly served upon the appellant and his counsel. However, appearance has only been entered on behalf of the respondent. It appears from the above that the appellant is not interest in prosecuting this appeal further. 3.
