A Petition under Section 528 of the BNSS, 2023 has been filed on behalf of the petitioner for expunging of remarks made by learned ASJ against the Advocate in its Order dated 28.05.2024 and also for waiver of cost of Rs.25,000/-.

It is submitted that in the Order dated 28.05.2024 the Junior Counsel who appeared on behalf of the main Counsel was not in a position to conduct the cross-examination and the observation of the learned ASJ to the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. effect "that the conduct of the Advocate was not proper" may impact his career in future.

The Advocate is a young boy of having two years of experience and therefore, the same may be corrected. It is further submitted that the cost of Rs.25,000/- that has been imposed by learned ASJ may also be waived.

Learned Prosecutor submits that she has no objection to the waiver of the cost.

In regard to the observations made in paragraph 'that the conduct of the Junior Counsel, who appeared in the Court by not cross-examining the witness, is not proper' is expunged from the Order dated 28.05.2024 of learned ASJ.

In so far as the request for waiver of cost of Rs.25,000/- is concerned, the learned counsel may move an appropriate application before the learned ASJ, who may decide the same sympathetically. 9.

The petition is accordingly disposed of.
