Petition under Section 528 of B.N.S.S., has been filed on behalf of the Petitioner, for quashing of FIR No. 1005/2021 dated 04.12.2021 under Section 420 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Burari, District North, Delhi and all the consequential proceedings emanating therefrom, in view of the Settlement Deed dated 01.07.2025.

Brief facts of the case are that the Respondent No. 2/Complainant, namely, Mr. Kunwar Bahadur Singh purchased a plot bearing Khasra No.52/9 admeasuring 200 sqr. Yards in Village Burari from its owner, Mr. Rajinder Tyagi for a consideration of Rs.34,000/- in 1990. The necessary documents, namely, GPA, Agreement to Sell, Affidavit and receipt dated 27.08.1990 were executed by Mr. Rajinder Tyagi, in favour of Respondent No. 2 and possession of plot was taken. In 1990, when the Respondent No. 2 came to his plot, he found the Petitioner along with other persons sitting there with lathi and dandas and told the Respondent No. 2 that the plot in question belongs to them. It is stated that the Petitioner wanted to take possession of the Plot of the Respondent No. 2, on the basis of forged documents. The parties submitted that the dispute was in regard to the plot of land, which has been returned to the Respondent No. 2/Complainant, in terms of the Settlement.

On the Complaint of the Respondent No.2/Complainant, FIR No. 1005/2021 dated 04.12.2021 under Section 420 of IPC got registered at Police Station Burari, District North, Delhi. 8.

With the intervention of the well-wishers and elders of the society of both the parties, Petitioner and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement Deed dated 01.07.2025. In the Settlement, it was inter alia settled between the parties that the Petitioner has now realized that the said property exclusively belongs to the Respondent No. 2 and the Petitioner has no right, title or claim over the said property. The Respondent No. 2, who is present in the Court, states that he has no objection if the said FIR is quashed.

Learned counsel for the Petitioner submits that the original property documents are with the Investigating Officer, to which there is no objection of being returned to the Complainant.

Let the same be returned, in accordance with law. 12.

Both the parties have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering the nature of the allegations and that they have settled the matter, the FIR No. 1005/2021 dated 04.12.2021 under Section 420 of the Indian Penal Code, 1860, registered at Police Station Burari, District North, Delhi and all the consequential proceedings emanating therefrom are quashed.

The Petition is disposed of accordingly.
