% 10.10.2025 CM APPL. 63812/2025 By way of the present application filed under section 151 of the Code of Civil Procedure 1908 read with section 16 of the Court Fees Act 1870 ('Court Fees Act'), the appellant seeks to withdraw the present appeal in view of Settlement Agreement dated 27.08.2025 arrived at through mediation before the Delhi High Court Mediation and Conciliation Centre, Delhi High Court, New Delhi.
A copy of the settlement agreement has been placed on record. Learned counsel on behalf of contesting respondent No.1 has joined via video-conferencing; and confirms the submissions made on behalf of the appellant.
In view of the above, and for the reasons stated in the application, which is duly supported by affidavit, the application is allowed. Application stands disposed-of.

RFA 535/2024 In view of the order passed above, the appeal is disposed-if as withdrawn, holding the parties bound by the terms contained in Settlement Agreement dated 27.08.2025.
Pending applications, if any, also stand disposed-of. The date of 12.11.2025 given earlier stands cancelled. Learned counsel for the appellant also requests that the court fee affixed on the memo of appeal be refunded to the appellant in terms of section 16 of the Court Fees Act, as applicable to Delhi. In view of the decision of a Division Bench of this court titled Nutan Batra vs. M/s Buniyaad Associates1, the Registry is directed to refund the entire court fees, to the appellant since the parties have settled the matter through mediation under the aegis of the Delhi High Court Mediation and Conciliation Centre, Delhi High Court, New Delhi, which attracts the applicability of section 16 (not section 16-A) of the Court Fees Act.
The Registry is directed to draw-up the requisite certificate in favour of the appellant for refund of the court fees.
