The petitioner is invoking the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India, seeking issuance of an appropriate writ, order or direction to the respondent/DDA to decide the appeal dated 19.11.2021 instituted by the petitioner in an expeditious manner.

Learned counsel for the respondent/DDA is present on advance notice and it is pointed out that as on today, no appeal is pending and only certain documents have been submitted by the petitioner, which are reflected in Annexure P3.

After some arguments, learned counsel for the petitioner requests permission to withdraw the present writ petition and institute fresh legal proceedings seeking appropriate relief in accordance with law.

Accordingly, the present writ petition is dismissed as withdrawn without prejudice.
