CORAM:

HON'BLE MR. JUSTICE MANMOHAN

O R D E R

% 17.04.2017 Present contempt petition has been filed alleging wilful disobedience of the judgment and order dated 07th February, 2008 by virtue of which W.P.(C) 566/2000 was allowed with a direction to the respondents to grant to the members of the petitioner association pay scale of Rs.110-180 since the year 1960 with all consequential benefits. Admittedly, nearly all members of the petitioner association have been granted pay scale of Rs.110-180 since 1960. However, today, learned senior counsel for petitioner association states that there are certain outstanding issues with regard to promotional

avenues and pay fixation of the members of the petitioner association. Keeping in view the fact that contempt proceedings are quasi criminal in nature, this Court is of the opinion that in the absence of specific directions, it is not possible to hold the respondents guilty of contempt, if any.

Consequently, present contempt petition and applications are closed and the notices issued are discharged.

However, petitioners are given liberty to raise the issues of promotional avenue and pay fixation in appropriate legal proceedings. MANMOHAN, J APRIL 17, 2017 js
