This petition has been filed, under Section 29A of the Arbitration and Conciliation Act, 1996, seeking extension of the mandate of the arbitral tribunal, which is in seisin of disputes between the parties under a Contract for the construction of Sagar bypass between km 351.000 to km 405.770 of National Highway 26 in the State of Madhya Pradesh, bearing contract package No. ADB-II/C9 in December, 2005. 2.

The mandate of the arbitral tribunal was extended from time to time, lastly by order dated 30.11.2023 in OMP (MISC) (COMM) 578/2023.

I am informed that the proceedings are at the stage of final arguments.

Ms. Ikshita Parihar, learned counsel for the respondent, appears on advance notice and states that the respondent has no objection to the relief sought.

In view of the above, and with the consent of learned counsel for the parties, the petition is allowed and the mandate of the arbitral tribunal is extended for a period of nine months, with effect from 14.08.2024. 6.

The petition, alongwith the pending application, stands disposed of in these terms.
