Present petition has been filed seeking directions to the Respondent Nos. 2 and 3 to appoint a New Returning Officer for conducting elections of the Managing Committee of the Petitioner No. 1 bank in accordance with the Delhi Co-operative Societies Act, 2003.

Learned counsel for the Petitioners states that the Petitioner No. 1 bank had sent a letter dated 15th January, 2024 to the Respondent No. 2 in pursuance of which the Respondent No. 3 had appointed a Returning The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Officer, i.e. Shri Vijender Kumar, Joint Secretary, H&FW, Department, GNCTD vide order dated 14th February, 2024. He, however, states that Shri Vijender Kumar failed to conduct the elections even after the expiry of the statutorily prescribed period of 90 days.

He further states that the Petitioner No. 1 bank wrote multiple letters to the Respondent No. 3 to address the issue of elections, with a final reminder dated 17th August, 2024, but the Respondent No. 3 has not acted upon the same.

Today, learned counsel for the respondents states that the respondents are willing to abide by any order to be passed by this Court. 5.
Accordingly, this Court disposes of the present writ petition as well as pending applications with a direction to the respondents to appoint a new Returning Officer within one week for conducting election of the managing Committee of the petitioner no.1 bank in accordance with Delhi Cooperative Societies Act, 2003 within 90 days.
