The present contempt petition has been filed for directions to the respondents to comply with the directions passed in order dated 11th October, 2023 in MAT.APP.(F.C.) 34/2023 passed by this Court. By the said order, directions had been given to the respondents to hand over the custody of the two minor children to the mother, i.e., petitioner herein. th 2.

When the matter was listed yesterday, i.e., 04 January, 2024, learned counsel for respondents submitted that the respondents have no objection to hand over the custody of the children to the mother. 3.

Learned counsel for respondents further submit that custody could not st October, 2023, as the respondents be handed over to the petitioner on 21 were unaware of the order dated 11th October, 2023 passed by the Division Bench of this Court in MAT.APP.(F.C.) 34/2023. She further submits that the two minor children are studying in Maharaja Agrasen School, Mundka, Delhi which is near to the residence of the respondents. She submits that the minor children are studying in Class 2 and Class 3 respectively. Thus, she submits that the petitioner-mother should give an undertaking that the academic year of the children shall not be spoiled and that they shall give the final examinations from the same school, which are slated to be held in March, 2024.

Learned counsel for petitioner upon instructions of the petitioner submits that petitioner shall not hamper the studies of the children from the school where they are studying presently and children shall duly take the final examinations from the same school in this session. 6.

The two children have been handed over to the mother in court. However, learned counsel appearing for the respondents is requested to accompany the children till the car of the mother. 7.

Respondents further undertake to hand over all the books of the children and other material which may be needed in the school for continuation of their education. Respondents are also directed to hand over the original of the documents viz. Adhaar Card and other certificates of the school, if any, to the petitioner.

In view of the aforesaid, since compliance of the order passed by this Court has been made, the contempt petition is disposed of.
