O R D E R

The present writ petition has been filed seeking issuance of directions to the respondent - Municipal Corporation of Delhi ("MCD") for demolition of the dilapidated property bearing Municipal no. 1928/1 to 1928/8, situated at Gali Durga Mandir, Lal Kuan, Delhi-110006. 2.

Learned counsel appearing for the petitioners submits that the property in question was constructed approximately 100 years ago and for the past several years, the same is in a dilapidated condition. It is submitted that the said property is not in a stable condition, and many parts of the same, have been destroyed in passage of time. Thus, it is submitted that the structure of the building can collapse at any time, being a century old building, especially, due to the current rainy season. This Court notes that in para 6 of the petition, it has been stated that the petitioners, along with other family members, have filed various suits for recovery of possession of the said property. Para 6 of the writ petition reads as under:

6. That in order to get the said property vacated, the Petitioners alongwith other Family members filed separate Suits for Recovery of Possession against the illegal occupier of the particular portions, details of which are as under:- xxx xxx xxx"

Considering that there are pending suits, which have been initiated at the behest of the present petitioners and their family members, it would be in the fitness of things, if an appropriate application with regard to the subject matter of the present writ petition, is filed in the said pending suits, in order to avoid any multiplicity of proceedings or any contradictory orders. 5.

This Court takes note of the submission of the petitioner that MCD is not a party in those suits. Accordingly, liberty is granted to the petitioners, to move an appropriate application for impleadment of MCD in the said suits, as and when such applications are filed by the petitioners, the same shall be consider at the earliest.

With the aforesaid directions, the present petition, along with the pending application, is disposed of.
