% 15.05.2025 I.A. 12367/2025 (Application under Section 151 of CPC, 1908 on behalf of Applicant/Defendant No. 33 for taking on record the details of proposed purchaser of the property bearing no. 32-A, Jafrabad Area, Shahdara, Delhi) 1.
The present application has been filed by Defendant No. 33 for placing on record the details of the proposed purchaser of the property bearing no. 32-A, Jafrabad Area, Shahdara, Delhi ('Property no. 32-A'). 2.
Further the Defendant No. 33 in the captioned application has expressed his inability to deposit the amount of Rs. 30 lakhs, though he admits that he is in possession of the Property no. 32-A. 3.
This Court finds no merit in the reasons set out in the application qua Defendant No. 33's inability to deposit the admitted amount of Rs. 30 lakhs due and payable to the Plaintiffs.

Defendant no. 33 states that property has been reconstructed and finishing work is being carried out. Defendant no. 3 and any person claiming through him are hereby directed to stop construction immediately in the property. Defendant No. 33 is directed to seal the property and deposit with The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. this Court the keys of the property no. 32-A within two (2) weeks. 5.
Defendant No. 33 or any person claiming through him is restrained from creating any third-party interest in Property no. 32-A. 6.
A copy of this order be sent to the concerned Sub-Registrar, Jafrabad Area, Shahdara, Delhi to ensure that no documents with respect to this property are registered as well as to the SHO, Police Station (P.S.) Seelampur for ensuring that no further construction is carried out at the said property and it is not occupied by any party. A copy of this order be sent to standing counsel, GNCTD (Civil and Criminal) for information and compliance.

Issue Court notice to Mr. Tushar Sannu, the Standing Counsel, Municipal Corporation of Delhi (MCD) for placing on record the Status Report with respect to the status of construction in the Property no. 32-A. 8.
Upon steps being taken by the Plaintiffs, issue notice to Mr. Ashok Pundhir whose details are set out in paragraph '10' of the captioned application which reads as under:
"Ashok Pundhir, S/o Sh. Bhagwan Singh, R/o D 155 near police station Seelampur, New Seelampur, North East Delhi, Delhi 110053. Also at D-174 D block, New Seelampur, Jafrabad, Delhi 110053". The copy of the Aadhar card of Ashok Pundhir is annexed herewith as Document A-1 for kind perusal of this Hon'ble Court."

Learned counsel for the Plaintiffs has joined the proceedings through video conferencing in a car. This is not acceptable. He is directed to remain personally present in Court on the next date of hearing or join the video conferencing link proceedings from his chamber. 10.
