The present contempt petition has been filed under Section 2(B), 11 and 12 of the Contempt of Courts Act, 1971 with a grievance that despite the interim stay granted by this Court on 13.12.2023 in WP(C) 16030/2023, the respondents have sought to move the petitioner to 49th Battalion, which is presently stationed in Tripura.

Learned counsel for the respondents, who appears on advance notice, submits that the said order directing the petitioner to move to the 49th Battalion has been recalled and assures the Court that till the writ petition bearing no. WP(C) 16030/2023 is taken up for consideration by this Court, the petitioner will be retained at Delhi.

In the light of the aforesaid, nothing further survives for adjudication in the present contempt petition, which is disposed of by directing the respondents to ensure that the orders passed by this Court in WP(C) 16030/2023 are strictly adhered to.

This order will, however, not come in the way of the respondents getting the petitioner examined by a Review Medical Board at Delhi.
