The present petition under Section 24 of the CPC seeks the following prayers:- "A. Transfer the petition bearing no. GP/117/2024 titled as Sh. Ram Singh & Anr vs Sh. Hoshiar Singh &Anr pending in the court of Sh. Arun Sukhija Ld. Judge, Family Court-02, West District, Tis Hazari court to the court of Ms. Navita Kumari Bagha Ld. Judge, Family Court-02, South West District, Dwarka Court and B. Pass any other and /or further order/direction/writs that this Hon'ble Court may deem fit and proper in the facts and circumstances of the case and in the interest of justice." 3.

The present petition has been filed seeking the aforesaid prayer by the maternal grand father of the child, who has filed Guardianship Petition No. 120/2024 titled Hoshiar Singh vs. Ram Singh & Anr., which is pending adjudication before learned Principal District Judge, District South-West, Dwarka. The other petition bearing no. GP 117/2024 has been filed on behalf of the paternal grandfather of the child titled Ram Singh & Anr vs Sh. It is matter of record that GP 117/2024 was filed at the first instance and an application under Order 7 Rule 10 of the CPC to return a plaint was filed on behalf of the petitioner in the aforesaid guardianship petition initiated on behalf of the paternal grandparents. The said application was dismissed by the learned Family Court vide order dated 27.11.2024. 5.

During the course of hearing, both the learned counsel for the parties consent that the guardianship petition bearing No. 120/2024 filed on behalf of the present petitioner may be transferred from Judge, Family Court, Dwarka to the Court of Family Court-02, West District, Tis Hazari and tried alongwith GP No. GP 117/2024 titled Ram Singh & Anr vs Sh. Hoshiar Singh &Anr. 6.

In view of the aforesaid, the present petition is disposed of with direction that GP No. 120/2024 shall be transferred to learned Family Court02, West District, Tis Hazari Courts. Let the records of the said petition be transferred to the concerned Court within a period of 10 days. Parties are directed to appear before the concerned Court accordingly. 7.

Copy of the order be communicated to the learned Principal Judge, Family Court, West, Tis Hazari Courts as well as learned Principal Judge, Family Court, Dwarka Courts, Delhi for necessary information and compliance.
