O R D E R

The petitioners are retired employees of the respondent No. 1 - Shaheed Rajpal Dav Public School ["the School"]. They have filed these writ petitions seeking payment of arrears of salary, MACP benefits, gratuity, provident fund, and other entitlements consequent upon implementation of the recommendations of the Sixth and Seventh Central Pay Commissions.

Ms. Gauri Puri, learned counsel, has entered appearance on behalf of respondent - School and its Managing Committee. She submits that the petitioners' entitlement to relief sought is not disputed, having regard to the settled legal position. However, the quantification of the dues in some cases requires reconciliation. She further submits that the School presently lacks the resources to liquidate the dues of all the petitioners immediately.

In view of the largely undisputed legal position, I am of the view that the exercise of reconciliation of accounts, quantification of dues, and working out appropriate modalities for payment thereof, ought to be carried out by the Directorate of Education ["DoE"], at the first instance. 4.

The School is directed to furnish its computation in respect of each petitioner to learned counsel for the petitioners, and submit the same with the concerned Deputy Director, DoE, within four weeks. The Deputy Director is thereafter directed to convene a meeting with the petitioners and the School or their representatives, within two weeks thereafter, to resolve any disputed issues of reconciliation and modalities for liquidation of the dues. This exercise be completed within 12 weeks from today.

It is made clear that if the School does not make any submission to the DoE within the period, granted by this Court, the DoE may proceed on the basis of the petitioners' computation. 6.

The writ petitions, alongwith pending applications, are disposed of with these directions, without prejudice to the rights and remedies of the parties.
