The present writ petition has been filed seeking a direction to the respondent no.1/ MCD to demolish the illegal structure/ encroachment in front of the house of the petitioner situated at ground floor of property bearing no. BG-6/250A, Paschim Vihar, Delhi-110063 (hereinafter 'subject property'), which is being undertaken by the respondent no.2, who is the occupier of first floor of the subject property. 2.
An Action Taken Report has been filed on behalf of the respondent no.1/ MCD wherein it is stated that the demolition order has been passed following due process of law. A demolition action was carried out on 16th May, 2025 and a vacation notice was also issued on 27th May, 2025. It is also stated that a fresh demolition action was carried out on 19th August, 2025.

Appellate Tribunal, MCD (ATMCD) wherein an interim status quo order has been passed.

In view thereof, the present writ petition is disposed of while directing the respondent no.1/ MCD to take appropriate action in accordance with law based on the outcome of the appeal.

In the meanwhile, a direction is issued to the respondent no.2 to completely clear the malba/ debris, which is lying on the ground floor of the subject property belonging to the petitioner.
