This is a petition seeking quashing of FIR No. 1278/2017 dated 02.12.2017 registered at PS Aman Vihar under Sections 288/304A of IPC. 2.
As per the FIR, the husband of respondent No. 2 and father of respondent Nos. 3, 4 and 5 and son of respondent No. 6 was an electrician and was cutting a grill on the first floor of property No. 111A, Vikas Vihar, Kiradi and while cutting the grill, he fell from the first floor and subsequently succumbed to his injuries.

Petitioner is present in Court and is identified by Mr. MC Verma, Adv. All the respondents are also present and identified by IO SI Sumit Dahiya, PS Aman Vihar.

During the pendency of the proceedings, parties have arrived at a settlement dated 29.06.2024, wherein the petitioner has agreed to pay a sum The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
of Rs. 6 lakhs in the name of the deceased wife in terms of full and final settlement and the parties have agreed to cooperate in quashing of the FIR. 5.
During the proceedings, the petitioner has stated that he will pay a total sum of Rs. 10 lakhs i.e. Rs. 6 lakhs plus 4 lakhs to the respondents in the name of respondent No. 2.

I am informed that Rs. 2 lakhs has already been paid and Rs. 4 lakhs is paid today vide DD No. 838178 dated 21.11.2024 drawn on Punjab National Bank and the balance amount of Rs. 4 lakhs shall be paid in the name of respondent No. 2 within 4 weeks from today. The proof of payment be placed on record within 6 weeks from today. 7.
Both the parties state that they have entered into the aforesaid settlement out of their own free will, volition and without any threat, force, undue influence or coercion.

There is no allegation of negligence on the part of the petitioner in the FIR and the death presumably is on account of an accident. 9.
I am convinced that quashing of such proceedings on account of compromise would bring about peace and would secure ends of justice. It is to be noted that no amount of money can substitute the loss of life. However, money can serve as a bridge to overcome the difficulties of life due to the loss of a family member. It can lessen the burden of the family members left behind. The proceedings are quashed as the respondents have decided to put a quietus to the matter. The Court does not see any fruitful purpose if criminal proceedings are permitted to be prosecuted any further. It is a fit case for quashing. In this view of the matter, there is no reason to continue the proceedings.

registered at PS Aman Vihar under Sections 288/304A of IPC is hereby quashed subject to the aforesaid payments.
