O R D E R

The present proceedings are instituted on behalf of the petitioner, who is seeking quashing of FIR No. 563/2022 registered under Sections 509/427/34 IPC at Police Station New Usmanpur, Delhi, on the ground that the parties have amicably settled their disputes. 2.
As per the allegations levelled in the FIR, the petitioner, after consuming alcohol, caused damage to the respondent No.2's scooter and used abusive language with the respondent No.2, causing her mental distress.

respondent No. 2 is the complainant/victim in the present case and that the petitioner is the only accused. He, on instructions, submits that the present case is pending investigation and that the charge-sheet has not been filed so far. He further prays that though the parties have compromised, the petitioner may be saddled with some costs considering the fact that the petitioner himself is a Jail warden and that the State machinery has already been put in motion.

Learned counsel for the petitioner submits that the present FIR was registered due to a misunderstanding and that with the intervention of family members and friends, the parties have amicably settled their disputes vide Settlement Deed dated 31.07.2024, a copy whereof has been placed on record. In terms of the said settlement, complainant is now left with no claims or grievances against the petitioner.

The petitioner and respondent No.2, who are present in Court, have been identified by their respective counsels as well as the I.O./ SI Suresh Kumar Meena (M:9968256274) P.S. New Usmanpur, Delhi. 6.
The petitioner has shown remorse for his conduct and undertakes not to repeat the same in the future. Respondent No. 2 also states that she has entered into the aforementioned compromise deed out of her own free will, volition and without any coercion. She further states that she has no objection if the present FIR and consequent proceedings are quashed. 7.
The parties shall remain bound by the statements made in Court today.

In view of the above facts and considering that no useful purpose will be served in continuance of the proceedings, it is directed that the aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
subject to payment of cost of Rs.20,000/- to be paid by the petitioner to the respondent No.2 by way of demand draft through the I.O. within two weeks and the proof evidencing receipt of payment shall be filed with the I.O. 9.
With the above directions, the petition is disposed of alongwith miscellaneous application.

In case the proof of payment of cost is not filed within two weeks, the I.O. shall be at liberty to move an appropriate application in this regard.
