This petition is filed by the Petitioner under Section 11(6) of Arbitration and Conciliation Act, 1996 ('1996 Act') for appointment of a Sole Arbitrator to adjudicate the disputes between the parties. 2.

Case of the Petitioner, as set out in the petition is that a Contract was executed between the parties on 17.10.2022 pursuant to a Tender issued by the Respondent on 28.04.2022 inviting bids for design, development and supply of EALPM. Purchase Order was issued on 16.11.2022 and Petitioner deposited security amount of Rs. 45.48 lakhs and commenced work. Subsequently, however, disputes arose between the parties and Petitioner invoked Arbitration Clause 33 of General Conditions of Contract by sending invocation notice dated 09.04.2025 to the Respondent. 09.05.2025, Respondent refused to consent to appointment of the Arbitrator and left it to the Petitioner to approach this Court for appointment. 3.

Learned counsel appearing on behalf of the Respondent, on instructions, while refuting the case of the Petitioner on merits, submits that since existence of the arbitration agreement is not disputed, this Court may appoint the Sole Arbitrator.

Accordingly, with the consent of the parties, Mr. Justice B.A. Khan, former Chief Justice of Jammu and Kashmir High Court (Mobile No. 9818000150), is appointed as the Sole Arbitrator to adjudicate the disputes between the parties. As agreed, fee of the Arbitrator is fixed as per Fourth Schedule of 1996 Act.

Learned Arbitrator shall give disclosure under Section 12 of the 1996 Act before entering upon reference.

It is made clear that this Court has not expressed any opinion on the merits of the case and all rights and contentions of the respective parties are left open.
