This is a Rectification Petition filed under Section 57 read with Section 125 of the Trade Marks Act, 1999, for cancellation / removal of Trade Mark 'PARKASHPOWER'

("Impugned Mark") bearing Registration No.

4798175 in Class 17 from the Register of the Trade Marks. 2.

The learned Counsel for Respondent Nos. 2 and 3, on instructions, submits that Respondent Nos. 2 and 3 have no objection if the present Petition is allowed and the Impugned Mark is removed / rectified / expunged from the Register of the Trade Marks.

In view thereof, the present Petition is allowed and the Impugned Mark being 'PARKASHPOWER' bearing Registration No. 4798175 in Class 17 is directed to be removed / rectified / expunged from the Register of the Trade Marks.
