This petition has been filed, challenging the Order dated 22.05.2025 passed by the learned Central Administrative Tribunal, Principal Bench, New Delhi (hereinafter referred to as the 'Tribunal') in O.A. No. 109/2024, titled Ravi Dutt v. Delhi Police &Ors., disposing of the O.A. filed by the respondent herein, with the following directions:
"7. In light of the above, the OA is allowed. We dispose of the OA with a direction to the respondents grant the applicant Functional Rank of ASI w.e.f. 10.06.2022, the date from his junior/batch-mate, i.e.
the respondent No.3, has been granted.It is made clear that the applicant shall be entitled to all notional benefits.
8. The above exercise shall be carried out by the respondents within a period of forty five days from the date of receipt of acertified copy of this Order."

From a perusal of the Impugned Order, we find that the learned Tribunal has allowed the aforesaid O.A. solely on the basis of an Order dated 28.08.2024 passed in O.A. No. 1392/2024, titled Inspector (Executive) Rajeev Kumarv. G.N.C.T of Delhi Through its Chief Secretary & Ors. We find that the learned Tribunal has not discussed the facts of the present case, or considered the defence, if any, offered by the petitioners herein. Further, the learned Tribunal has also granted the relief of Functional Rank of ASI to the respondent with effect from 10.06.2022.

In the peculiar facts of the present case, and finding that the Impugned Order cannot be treated as a reasoned order, we set aside the same and remand the matter back to the learned Tribunal for a fresh consideration ofthe O.A.

For the said purpose, the parties shall appear before the learned Tribunal on 16th December, 2025.

We make it clear that we have not examined the merits of the submissions made by either of the parties, and the same shall remain open for adjudication by the learned Tribunal. The Impugned Order has been set aside only on the limited ground that it lacks adequate reasoning.

The petition, along with the pending application, is disposed of in the aforesaid terms.
