The Petitioner's grievance is that he has not been issued a Scheduled Caste Certificate. In this regard, a status report dated 7th September, 2024 has been filed by Respondent No. 3/SDM North East, Seelampur, which reads as under:

"1. That it is relevant to mention that Sunny S/o Sh. Ram Chandra applied for a Scheduled Caste (SC) certificate on 09.06.2024 in the office of Tehsildar, Seelampur and verified his documents on 14.06.2024. He provided his father's Scheduled Caste certificate (Sh. Ram Chandra S/o Sh. Chedi Lal), which was issued on 24.02.1972, as a supporting document. As the old records at the Tehsildar office (Seelampur) are available only from 09.09.1996 onwards, the verification of this caste certificate was referred to the CCS Branch of the Revenue (HQ). A reply was received stating that the supporting caste certificate provided was not a photocopy of the original as sign of issuing authority was not there on certificate.

2. On 04.09.2024, an online query was raised requesting the applicant to upload the original copy of the certificate and the applicant was also informed about this. On 06.09.2024, the applicant visited the office and said that he would upload the original certificate and have it verified. However, the original caste certificate was not uploaded as of the evening of 06.09.2024. Further, as soon as the petitioner will submit the required documents though online portal the certificate will be issued." From the above, it is evident that the Petitioner has relied on a document purported to be his father's caste certificate as a supporting document, however, he has not produced the original of the said certificate for verification. In these circumstances, the Petitioner's request for caste certificate has not been granted.

Counsel for Petitioner has handed over across the board a laminated copy of the Petitioner's father's caste certificate, which has been perused and returned to him. It is clearly noticed that it is not an original but only a true copy. Counsel for Petitioner asserts that the said caste certificate dates back to the year 1972, and he is not in possession of the original document. 4.

In the opinion of the Court, even in absence of the original of the supporting document, the Petitioner must still fulfil the requirements mandated for issuance of a caste certificate. Accordingly, the Petitioner is directed to follow up with the concerned department which has issued the original caste certificate of his father. At the same time, the Respondents are directed to send a communication to the concerned Office of the Deputy Commissioner to verify whether the certificate No. 1351/CCS/72/CASTE dated 24th February, 1972 issued in the name of Ram Chander, S/o Shri Chedi Lal, R/o RA/12/14 Lal Kila Delhi-6, was issued by the Department. Upon receiving a response, the Respondents shall process the Petitioner's application in accordance with law.
