O R D E R

% 21.03.2017 Learned counsel appearing for the respondents submits that, in the peculiar facts of the present case and, without prejudice to the rights and contentions of the parties, the respondents are willing to consider the representation of the petitioner on merits. It is submitted that though, as per their record, there is litigation pending vis-a-vis rights of the petitioner in respect of the subject property, however de hors the same, the respondents are willing to consider the representation of the petitioner without the same amounting to an acknowledgment of any right of the petitioner to title of the property. In view of the above, the writ petition is disposed of directing the respondents to consider on merits, the reply/representation of the petitioner, already submitted. However, the petitioner is given liberty to file any further documents or representation in support of her case within four weeks.

It is clarified that this Court has neither examined nor commented upon the alleged rights of the petitioner vis-a-vis the said property and this order is without prejudice to the rights of the parties litigating with the petitioner.

The petitioner shall also be entitled to a personal hearing prior to the disposal of the show cause notice issued in respect of the subject property.
