On the first call, none was present on behalf of the plaintiff. Same is the position on the second call. Mr. Aggarwal, learned counsel for the defendant submits that in the interregnum, he has telephonically contacted Mr. Sunil Malhotra, counsel for the plaintiff, who has stated that he is out of station and that he has no objection to the suit being transferred to the subordinate court vested with the territorial jurisdiction in that regard.

In view of the Notification No.27187/DHC/Orgl.

dated 24.11.2015, issued under Section of the Delhi High Court (Amendment) Act, 2015 (Act 23 of 2015), at the request of the counsel for the defendant, the present suit is transferred to the Court CS(OS) 846/2011

of the District Judge (North West), Rohini Courts Complex for further proceedings before the competent court on 28th March, 2016. 3.

As none is present on behalf of the plaintiff, learned counsel for defendant shall give a written intimation of the next date fixed before the District Court to the counsel for the plaintiff and place on record proof of intimation.
