% 01.04.2016 C.M. Appl. No.8617/2016 This is an application under Section 5 of Limitation Act seeking condonation of delay in filing the industrial dispute. Ms. Neelam Tiwari, learned counsel for the petitioner submits that she will file the application for condonation of delay before the Industrial Court along with industrial dispute and does not want to press the present application.

Accordingly, the application is dismissed as not pressed. C.M. Appl. No.8616/2016 This is an application under Section 151 CPC seeking permission to withdraw the present petition filed on behalf of petitioner with liberty to

raise an industrial dispute.

Mr. A.K. Mishra, Advocate appearing on behalf of respondent No.2 submits that he has no objection if the petition is dismissed as withdrawn. However, he will oppose the petition to be filed before the Industrial Tribunal as well as application for condonation of delay. In view of the submissions made by learned counsel for the parties, the application is allowed.

The application stands disposed of.
