Learned counsel appearing on behalf of the petitioner/applicant submitted that the instant application has been filed under wrong Sections and thus, he may be permitted to withdraw the same with liberty to file a fresh application mentioning the correct Sections under which the applicant has been charged.

Learned Additional Public Prosecutor appearing on behalf of the State vehemently opposed the instant application, however, he is not opposing the prayer for withdrawal of the instant bail application. 3.

In view of the above, leave is granted and the application is dismissed as withdrawn with liberty to file a fresh application mentioning the correct Sections under which the applicant has been charged.
