Petitioners have filed an eviction petition on the ground of bonafide requirement under Section 14(1)(e) of Delhi Rent Control Act, 1958.

Said petition was filed way back on 03.06.2010 and though applications seeking leave to defend have been filed by the concerned respondents, but the arguments have yet not taken place on account of the fact that some miscellaneous applications, in the interregnum, have been moved by the parties.

The case is now, reportedly, fixed for 31.08.2024. 4.

The prayer in the present petition is merely to the effect that the learned Trial Court be requested to consider the applications seeking leave to defend in a time-bound manner.

It is obvious from the facts mentioned in the present petition that By:SONIA THAPLIYAL 13:19:19 CM(M) 3229/2024

the abovesaid eviction petition, which needs to be tried in a summary manner being on the ground of bonafide requirement, needs to be fast-tracked. It was filed in the year 2010 and for some reasons, the learned Trial Court is yet not in a position to hear the arguments on applications seeking leave to defend.

Keeping in mind the overall facts and circumstances of the case and the fact that the abovesaid petition is pending for the last around 14 years, the present petition is disposed of with request to the learned Trial Court to take up the abovesaid applications seeking leave to defend and to dispose those of, as expeditiously as possible, preferably, within six months from today.

Needless to say, if any miscellaneous application is to be considered prior to taking up such applications seeking leave to defend, the learned Trial Court shall consider all those applications also well in advance so that there is no further delay in disposal of the applications seeking leave to defend.

The petition stands disposed of in the above terms. 9.
