By way of the present petition, the petitioner seeks quashing of the FIR bearing No. 357/2023, registered at Police Station Begumpur, Delhi, for the commission of offences punishable under Sections 379/420 of the Indian Penal Code, 1860 (hereafter „IPC') and all consequent proceedings emanating therefrom on the basis of settlement arrived at between the parties.

The petitioner and respondent no. 2 are present before this Court and have been identified by their counsel and Investigating Officer (IO) concerned, Police Station, Begumpur, Delhi.

Brief facts of the case are that the marriage between the petitioner and the respondent no. 2 was solemnized at Delhi on 25.11.1996, in accordance with Hindu rites and ceremonies. It is stated that one child was born out of the said wedlock. On 30.06.2021, respondent no. 2 returned to his residence after work and found the locks of the main gate and his room broken. Upon inspection, respondent no. 2 further noticed that the trunk of his car had been opened and several important documents were missing therefrom, including his bank passbook and cheque book. Subsequently, on 06.07.2021, a cheque bearing the signature of respondent no. 2 was used to withdraw an amount of INR 48,000/- from his bank account. Respondent no. 2 received an alert message regarding the said withdrawal on 07.07.2021. Thereafter, respondent no.
2 made a PCR call and lodged a complaint against the petitioner under relevant Sections, alleging theft and fraudulent withdrawal of money from his account. It is stated that with intervention of the family and friends, the parties have now amicably settled their dispute vide Settlement Agreement dated 02.11.2023. In furtherance of the aforesaid Settlement Agreement, the petitioner and respondent no. 2 jointly filed a petition under Section 13-B(1) of the Hindu Marriage Act, 1955 seeking dissolution of marriage by way of mutual consent before the Ld. Principal Judge, Family Court, North District, Rohini Courts, Delhi, on 18.12.202, and the same has since been allowed/granted in favour of the parties. 18.

compromise out of his own free will and without any pressure, coercion or threat. It is stated that he has already received the amount as per the said Settlement Agreement. Therefore, she has no objection if the present FIR is quashed.

Although, the affidavits showing the protection of interest of minor child, as per the judgment titled as Ganesh vs. Sudhirkumar Shrivastava: (2020) 20 SCC 787 passed by the Hon‟ble Supreme Court, have not been filed by the learned counsel for the petitioners, however, the parties will remain bound by it.

In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 21.
Accordingly, FIR bearing No. 357/2023, registered at Police Station Begumpur, Delhi, for the commission of offences punishable under Sections 379/420 of IPC and all consequential proceedings emanating therefrom are quashed.
