Petitioners are the Respondents in a petition filed by Respondent No. 2/Mr. Sher Singh under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 bearing case No. 480/S.C./DC(NW)/2022. 2.

According to Petitioners, Respondent No. 1/ the District Magistrate before whom the matter1 is pending, is violating the principles of natural justice by not affording the Petitioner an opportunity of hearing. They assert that they have appeared before Respondent No. 1 and requested the court to hear the Petitioners and also filed an urgent application, which was allocated Diary No. 10286. The same was directed to be taken up on 07th August, 2024, however, on the said date also, the Petitioners were not given any hearing. Subsequently, they again appeared before Respondent No. 1 on 09th 1 bearing case no 480/S.C./DC(NW)/2022 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. August, 2024, yet the matter was not heard.

In such circumstances, Petitioners seek a direction to Respondent No. 1 to hear them. It is pointed out that no final order has been passed in the proceedings.

The Court, without going into the merits of the application, can only observe that whenever Respondent No. 1 would take up the case no 480/S.C./DC(NW)/2022, Petitioners be afforded an opportunity of hearing. 5.

With the above directions, petition is disposed of, along with pending application.

The Court has not expressed any opinion on the merits of the case. All rights and contentions of the parties are left open.
